2. Evaluation Criteria

The MBA Team may assess submissions based on the following criteria:

Artistic merit and emotional depth

Uniqueness and creative expression

Musicality (for lyrical submissions)

Audience engagement and overall impact.

The evaluation process is solely at the discretion of the MBA Team, which shall not be required to provide any explanation or feedback.

3. Nature of Engagement

The submission does not guarantee selection or any further contractual engagement.

The MBA Team shall not charge any costs or fees to You at any stage of this selection process.
circle
If the MBA Team elects to proceed with Your submission, You may be contacted for further discussions and/or to execute a long-form agreement.

If Your submission is selected and commercialised, You may receive a portion of the net realised revenue, in accordance with the long-form agreement.

This initiative is a creative partnership whereby the MBA Team is investing in artistic ideas and reserves full creative control over the submissions and resulting works.

These Terms do not create any exclusive arrangement between You and the MBA Team. The MBA Team may engage with other artists, developers, and collaborators without restriction.

You agree to notify the MBA Team, through the website of Mainbhiartist.com, if You are a member of any collective rights management organisation or copyright society

4. Intellectual Property and Attribution

Upon selection and integration of Your submission into any work developed by the MBA Team, You hereby irrevocably and perpetually assign to the MBA Team all worldwide rights, title, and interest in the submitted work and all derivative works, including all intellectual property and allied rights therein, for the full term of such rights and any extensions or renewals thereof.

The MBA Team shall have the unrestricted right to adapt, modify, remix, translate, commercialise, and exploit the work, in any mode, medium or format, upon submission and selection.

You represent and warrant the following:

Your submission is original and unpublished, and you own all rights, title and interest in the submission, and are permitted to transfer all rights in the submission to the MBA Team
circle
Your creation and submission of, and the MBA Team’s use of the submission does not infringe or otherwise violate the rights of any third party, including such third-party’s intellectual property rights;
circle
The submission is unencumbered by any third-party rights or possible claims, including that of a collective rights management organization or copyright society.

If Your submitted work is selected by the MBA Team, You hereby irrevocably waive, to the extent permitted under applicable Indian law, all moral rights in relation to the submitted work, including the right to object to modification, distortion, or adaptation of the work by the MBA Team.

4. Intellectual Property and Attribution

You shall not share, license, adapt, or use the submitted work or any part thereof with third parties after submission, except with prior written consent of the MBA Team. If the submission or any part thereof is not selected for commercialisation, this restriction shall remain in effect for Six (6) months following the date of submission, after which You may use the work elsewhere, unless otherwise notified in writing by the MBA Team.

Attribution of the Artist shall be at the sole discretion of the MBA Team. The format, placement, and visibility of any such credit shall be determined exclusively by the MBA Team, and the absence of attribution shall not entitle the Artist to any claim or compensation.

Upon selection, the MBA Team shall have the unrestricted right to license, assign, sublicense, or otherwise transfer any or all rights in the final work to any third party, digital platform, affiliate, or distributor, for any purpose, globally and in perpetuity.

You hereby grant the MBA Team a worldwide, perpetual, irrevocable, and royalty-free license to use Your name, image, and likeness, in connection with Your submission, or any part thereof, including for purposes of promotion, publicity, and commercial use, in any media now known or hereafter developed.

5. Confidentiality

You agree to maintain strict confidentiality regarding any non-public information shared in connection with Your submission or any potential collaboration.

Confidential information includes, without limitation, artistic concepts, draft versions, communication exchanges, and monetisation strategies.

This obligation shall survive the termination of any engagement and remains enforceable for an indefinite period.

6. Indemnity

You shall fully indemnify, defend, and hold harmless the MBA Team, its members, affiliates, officers, and agents, from and against any and all losses, damages, claims, liabilities, and expenses (including reasonable legal fees)

Arising from breach of these Terms; If Your work is selected for commercialisation, then arising from:

Any third-party claim relating to infringement, misappropriation, or violation of intellectual property rights;
circle
Violation of any applicable law, regulation, or contractual obligation.

7. Limitations and Disclaimers

To the fullest extent permitted under law, the MBA Team shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, or reputational harm, arising from or in connection with Your submission or these Terms.Insert your text here

8. Consideration

Any consideration payable to You, if applicable, shall be governed by and subject to the terms outlined in the long-form agreement to be executed upon selection of Your submission.

9. Right to Modify, Suspend or Terminate

The MBA Team reserves the right to cancel, modify, suspend, or terminate this initiative or these Terms, in whole or in part, at any time, for any reason, including due to force majeure or unforeseen circumstances, without incurring any liability.

Clauses relating to intellectual property, confidentiality, governing law and jurisdiction, indemnity, limitation of liability, and other clauses that survive by nature shall survive the end of the collaboration process.

10. Governing Law and Jurisdiction

 These Terms shall be governed by, and construed in accordance with, the laws of India.

All disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka

The MBA Team is committed to upholding the highest standards of data protection and privacy for all users interacting with its Website, in compliance with applicable laws.

The MBA Team collects, processes, stores, and transfers personal information of users for purposes including but not limited to submission management, user authentication, communication, analytics, and platform improvement.

The MBA Team recognises the importance of transparency in data processing practices and seeks to provide users with clear information regarding their rights, obligations, and available remedies under applicable law.

1. DEFINITIONS

“Personal Data” shall mean and include any information relating to an identified or identifiable natural person who is a user of the Website, including but not limited to name, contact details, city, email address, mobile number, IP address, device identifiers, and any other information collected directly or indirectly through the Website.

“Submission” shall mean and include any original work or content submitted by a User through the Website for evaluation or potential commercialisation by the MBA Team.

“Cookie” shall mean and include any small data file placed on a User’s device by the Website or third-party service providers for purposes of tracking usage patterns, enhancing user experience, or delivering targeted content.

“Data Processing” shall mean and include any operation or set of operations performed on Personal Data, including collection, recording, organisation, structuring, storage, adaptation, retrieval, consultation, use, disclosure by transmission, dissemination, alignment, restriction, erasure or destruction.

“Third-Party Service Provider” shall mean and include any external entity engaged by the MBA Team to provide ancillary services such as analytics, hosting, marketing or payment processing in connection with Platform Services.

“International Data Transfer” shall mean and include any transfer of Personal Data outside the territory of India to jurisdictions that may have different data protection standards.

“Lawful Basis” shall mean and include any legal ground recognised under DPDPA 2023 or international privacy laws for processing Personal Data, including consent, contractual necessity, legitimate interests or compliance with legal obligations.

“Automated Decision-Making” shall mean and include any decision made solely on the basis of automated processing of Personal Data without human intervention that produces legal effects concerning a User or similarly significantly affects a User.

“Data Subject Rights” shall mean and include all rights granted to Users under DPDPA 2023 and applicable privacy laws, including access, rectification, erasure, restriction of processing, portability and objection.

2. PLATFORM SERVICES DESCRIPTION

Platform Services include submission forms requiring entry of Personal Data such as name, mobile number, email address and city.

The Platform further facilitates communication between Users and the MBA Team regarding submissions, selection processes, feedback (where applicable), and potential commercialisation opportunities as outlined in the Terms of Use.

Ancillary features may include newsletters, updates on initiatives or events organised by the MBA Team or its affiliates, user account management tools (where applicable), and interactive functionalities designed to enhance user engagement.

The Platform may integrate third-party services for analytics, marketing automation or payment facilitation (if introduced), each governed by their respective privacy policies as referenced herein.

3. USER OBLIGATIONS AND ACCEPTABLE USE POLICY

Users shall provide only accurate, complete and up-to-date information when submitting works or interacting with Platform Services; any misrepresentation or fraudulent submission shall constitute a material breach of this Policy.

Users shall not submit content that infringes upon third-party intellectual property rights or violates any law; each User hereby represents that their submission is original and unencumbered by third-party claims as further detailed in this Policy.

Users shall not use the Platform for unlawful purposes, including but not limited to dissemination of malicious code, unauthorised access attempts (“hacking”), spamming or harassment of other users or MBA Team members.

Users shall not circumvent technical restrictions implemented on the Platform nor attempt to gain unauthorised access to restricted areas or confidential information belonging to other users or the MBA Team.

Users shall promptly notify the MBA Team if they become aware of any security incident or unauthorised use of their credentials in connection with Platform Services.

Users are prohibited from reverse engineering, decompiling or otherwise attempting to derive source code from any component of the Platform.

Users shall comply with all additional guidelines published by the MBA Team regarding acceptable use of Platform Services; repeated violations may result in suspension or termination of access as described in this Policy.

4. DATA PROTECTION AND PRIVACY PRACTICES

a) Data Collection Practices 
The MBA Team may collect Personal Data directly submitted by Users when they visit the Website and submit original works via designated forms, subscribe to newsletters or otherwise interact with Platform Services. Data collected includes but is not limited to name, mobile number, email address, city and details pertaining to submitted works. Technical information such as IP address, browser type and device identifiers is automatically collected through cookies and analytics tools for security monitoring and service optimisation purposes. The MBA Team may also receive Personal Data from third-party sources where permitted by law; all collection activities are conducted in accordance with DPDPA 2023 requirements.

b) Purposes of Processing & Lawful Bases 
Personal Data is processed primarily for providing Platform Services, including submission management, user authentication and communication regarding submissions; such processing is based on contractual necessity or legitimate interests as recognized under Applicable Law. Secondary purposes include marketing communications (where consented), product development analytics, fraud prevention and legal compliance; each processing activity is supported by an appropriate lawful basis such as consent or statutory obligation. Automated decision-making may be employed for personalised content delivery or risk assessment; safeguards are implemented to protect User rights in relation to such processing activities. International data transfers may be conducted only with adequate safeguards such as standard contractual clauses or binding corporate rules as required by law.

Users may exercise their right to rectification (correction), erasure (deletion), restriction of processing or data portability (transfer), subject to legal limitations; responses shall be provided within statutory timeframes prescribed under Applicable Laws. All User rights are subject to verification procedures designed to prevent unauthorised disclosures; further details on exercise procedures are available upon written request.
d) Data Security Measures  
The MBA Team implements comprehensive technical and organisational measures to protect Personal Data against unauthorised access, disclosure or destruction; such measures include encryption (in transit and at rest), access controls based on least privilege principles and regular security audits conducted by qualified professionals. Users are encouraged to report suspected vulnerabilities via designated contact channels.

Upon expiration of retention periods or upon valid erasure requests from Users (where permissible), Personal Data is securely deleted or anonymised.
f) Cookie & Tracking Technology Disclosure 
The Website uses cookies, web beacons and similar tracking technologies for purposes including session management, analytics reporting and targeted advertising. g) International Data Transfers & Safeguards 
All Personal Data is processed and stored on servers located within India unless international transfer is explicitly necessary and compliant with DPDPA safeguards. Where Personal Data is transferred outside India for processing by affiliates or service providers located in jurisdictions with differing data protection standards, such transfers are conducted only pursuant to legally recognised safeguards such as adequacy decisions issued by Indian authorities or execution of standard contractual clauses approved under DPDPA 2023. The MBA Team ensures that recipients of Personal Data provide an adequate level of protection consistent with this Policy; Users may request further details regarding international transfer mechanisms upon written inquiry.
h) Children’s Privacy
The Platform is not intended for Users under the age of 18. No Personal Data is knowingly collected from children. If the MBA Team learns that Personal Data of a child has been collected without verified parental consent, such data shall be deleted immediately.

5. CONSENT MANAGEMENT AND WITHDRAWAL MECHANISMS

The MBA Team ensures that Users are provided with clear and specific notices before obtaining consent for the collection or processing of Personal Data. Consent may be withdrawn at any time by sending an email to . Upon withdrawal, the MBA Team shall cease further processing unless required under Applicable Law.

6. INTELLECTUAL PROPERTY RIGHTS AND USER-GENERATED CONTENT

a) Ownership of Platform Content
All intellectual property rights in Platform Services, including software codebases, website design elements, trademarks (“Main Bhi Artist”, “MBA Team”), logos and proprietary content are owned exclusively by the MBA Team or its licensors; unauthorised use is strictly prohibited except as expressly permitted herein.
b) User Submissions & Assignment of Rights 
Upon selection and integration of a User’s submission into any work developed by the MBA Team, all worldwide rights (including copyright) in such submission are irrevocably assigned to the MBA Team for the full term of protection, including renewals/extensions thereof; this assignment includes all derivative works created therefrom.
c) License Grants & Moral Rights Waiver 
d) Users hereby grant the MBA Team a worldwide perpetual royalty-free license to use their name/image/likeness in connection with submissions for promotional/commercial purposes; attribution remains at the sole discretion of the MBA Team. To the extent permitted under Applicable Laws, Users hereby waive all moral rights relating to selected submissions, including the right to object to modification/distortion/adaptation thereof by the MBA Team.
e) Restrictions on Use & Attribution Rights
The Users shall not license/share/adapt submitted works with third parties post-submission, except with prior written consent from the MBA Team; if submission is not selected, such restriction applies for six months post-submission unless otherwise notified in writing by the MBA Team. Attribution format/placement/visibility remains at the exclusive discretion of the MBA Team; absence thereof does not entitle the User to claim/compensation.
c) Data Retention & Deletion Obligations Post-Termination
Upon termination or deactivation, Personal Data associated with the User's account or submissions shall be retained only as long as necessary for legal or regulatory purposes, after which it will be securely deleted or anonymised, per this Policy. Anonymised data may be retained indefinitely for statistical analysis, provided it cannot be re-identified.
d) Post-Termination Consequences
Termination does not affect accrued rights or obligations existing prior thereto, nor does it affect survival clauses specified herein, including those relating to intellectual property, data protection, confidentiality, liability, governing law, and dispute resolution, which remain enforceable indefinitely post-termination.

10. SURVIVAL OF CERTAIN CLAUSES

All provisions in this Policy relating to data protection and privacy obligations, intellectual property rights, confidentiality, limitation or exclusion of liability, governing law and jurisdiction, dispute resolution, and regulatory compliance shall survive the termination or expiry of this Policy indefinitely, unless otherwise expressly stated herein or required under Applicable Law.
To the fullest extent permitted under Applicable Law, the MBA Team disclaims all liability for indirect/incidental/special/consequential/punitive damages arising from User’s use/inability to use Platform Services, including loss-of-profits/data/reputation, even if advised of the possibility thereof.

11. GOVERNING LAW AND JURISDICTION

This Policy shall be governed by and construed in accordance with the laws of India, including the DPDPA 2023, the IT Act 2000, and other applicable statutes or regulations relating to digital platforms, data protection, privacy, consumer protection, and intermediary liability, as amended from time to time, without regard to conflict-of-law principles. Exclusive jurisdiction over disputes arising hereunder vests in the courts located at Bangalore, Karnataka, India, subject always to the dispute resolution procedures set forth below.

7. PLATFORM AVAILABILITY AND MODIFICATIONS

a) The MBA Team endeavours to maintain continuous availability of Platform Services, subject to planned maintenance windows, which may be notified in advance via Website announcements where feasible; emergency maintenance may occur without prior notice where necessary for security/stability reasons.
b) The MBA Team reserves the right to modify/update/discontinue features/functions/services offered via the Platform at any time without liability; significant changes impacting the User experience shall be communicated via email/Website notifications where practicable.

8. LIABILITY AND DISCLAIMERS

To the fullest extent permitted under Applicable Law, the MBA Team disclaims all liability for indirect/incidental/special/consequential/punitive damages arising from User’s use/inability to use Platform Services, including loss-of-profits/data/reputation, even if advised of the possibility thereof.

9. TERM AND TERMINATION PROVISIONS

a) User Account Termination Procedure
Users may request termination or deletion of their account (where applicable) at any time via written notice or email. Upon receipt, the MBA Team shall deactivate the account within a reasonable period, subject to verification procedures designed to prevent unauthorised deletions.
b) Platform Discontinuation Scenarios
The MBA Team reserves the right, at its sole discretion, to discontinue or suspend Platform Services (in whole or in part) at any time due to business, technical, or legal reasons, without incurring liability towards Users, except as required under Applicable Law. Advance notice shall be provided where feasible.

12. DISPUTE RESOLUTION FRAMEWORK

a) In the event of any dispute or controversy arising out of or relating to this Policy or the User’s use of the Platform, the Parties shall first attempt amicable resolution through good-faith negotiations or mediation, administered by a mutually agreed mediator located at Bangalore, Karnataka, India, within thirty (30) days from the date of written notice of dispute.
b) If mediation fails, the dispute shall be finally resolved by binding arbitration, conducted in the English language before a single arbitrator mutually appointed by the Parties under the Arbitration & Conciliation Act, 1996 (as amended). The venue and seat of arbitration shall be Bangalore, Karnataka, India.
c) The arbitrator’s award shall be final and binding upon the Parties and enforceable in the competent courts at Bangalore, Karnataka, India..
d) Nothing herein precludes either Party from seeking interim or injunctive relief before the competent courts at Bangalore, Karnataka, India, pending the constitution or outcome of arbitration proceedings.
e) Each Party shall bear its own costs and legal fees, unless otherwise determined by the arbitrator.
f) This Section survives the termination or expiry hereof.
g) Provided, however, that nothing herein restricts statutory rights or remedies available under DPDPA 2023, IT Act 2000, or other applicable laws.

13. REGULATORY COMPLIANCE

a) The MBA Team hereby affirms ongoing compliance efforts with the DPDPA 2023, including the appointment or designation of a Data Protection Officer, implementation of technical and organisational measures, notification of personal data breaches within statutory timeframes, facilitation of User rights exercise, and maintenance of records or audit trails relating to data processing activities.
b) Users may escalate unresolved grievances relating to data protection or privacy matters to designated regulatory authorities, per procedures prescribed under DPDPA 2023. 
c) In accordance with Section 13 of DPDPA 2023, Users may file grievances by submitting a written complaint to the Data Protection Officer via the email mentioned below. A response shall be provided within n (7) business days. Users unsatisfied with the resolution may escalate to the Data Protection Board of India.

14. AMENDMENTS AND UPDATES

a) The MBA Team reserves the right to amend or update this Policy at any time in response to changes in legal or regulatory requirements, technological developments, business practices, or user feedback.
b) Material changes impacting User rights or obligations shall be notified via email or Website announcements prior to the effective date of such amendment.
c) Continued use of Platform Services post the effective date constitutes deemed acceptance of the revised Policy.
d) Users are encouraged to review the Policy periodically for the latest updates.
e) Historic versions of the Policy may be made available upon written request.
